Although a battery report had already been filed with the police, LAX authorities did not arrest Mr. West upon arrival because it did not meet their criteria for an infraction under the penal code that stated there must be visible proof of injury or harm done to another person in order to file charges for this type of crime, said Mr. Kump who also noted how his client’s mother would have been contacted by authorities if he had physical injuries or bruises, which was not the case.
